This website is operated by PrimaVista. Throughout the site, the terms “we”, “us” and “our” refer to PrimaVista.
These Terms of Service (“Terms”) govern your access to and use of the PrimaVista website, online store, products, and related services (the “Services”).
By accessing our website, placing an order, or purchasing a product from us, you agree to these Terms together with any policies referenced in them, including our Return and Refund Policy, Shipping Policy, and Privacy Policy.
Nothing in these Terms is intended to exclude, restrict, or limit any rights that cannot lawfully be excluded, restricted, or limited under applicable law.
1. Online store terms
By using the Services or placing an order, you confirm that you are legally able to enter into a binding agreement under the laws applicable to you.
You may not use the Services, website, or products for any unlawful, fraudulent, abusive, or unauthorized purpose.
You must not interfere with the operation or security of the website, transmit malicious code, misuse the Services, or violate the rights of PrimaVista or any third party.
2. Electronic contracting and order process
Orders are placed electronically through our online checkout.
Before submitting your order, you are responsible for reviewing the information displayed at checkout, including:

shipping address;

billing and contact information; and

any other information relevant to the transaction.
The checkout process allows you to review and correct information before completing your purchase.
The language currently used for online contracting with PrimaVista is English.
After an order is placed, an electronic order confirmation is normally sent to the email address provided at checkout.
Electronic order records are maintained through our ecommerce systems for order administration, customer service, accounting, fraud prevention, legal compliance, and related legitimate business purposes.
Where available, order information may also be accessible through customer account or order-status features provided by our ecommerce platform. You may contact us if you require information about a previous order.
An order confirmation acknowledges that we have received your order. Orders remain subject to review, acceptance, availability, payment processing, and fulfillment.
3. Products and availability
PrimaVista offers made-to-order, print-on-demand products, including fine art posters, wall calendars, premium tote bags, and phone cases.
Products, designs, variants, prices, and availability may change.
We reserve the right to modify, discontinue, limit, or remove products from the store for future orders without prior notice.
Product availability is not guaranteed until an order has been accepted and can be fulfilled.
4. Product images and descriptions
We make reasonable efforts to display product images, colors, descriptions, dimensions, and other details as accurately as possible.
However, the appearance of colors may vary depending on your screen, device settings, display technology, lighting, and production process.
Product photographs and mockups are intended to represent the product but may include styling elements that are not part of the purchase.
Because our products are produced on demand, minor variations in printing, placement, cropping, color, finish, or other production characteristics may occur.
Such minor variations do not necessarily constitute a product defect.
5. Orders and order acceptance
When placing an order, you agree to provide accurate, complete, and current information.
PrimaVista may review an order before it is submitted to or completed by the fulfillment process.
We may refuse, cancel, or limit an order where reasonably necessary, including in cases involving:

suspected fraud or unauthorized payment activity;

incomplete or inaccurate order information;

pricing or technical errors;

product or production unavailability;

inability to fulfill or ship the order;

suspected misuse of the website or Services; or

violation of these Terms or our other policies.
If PrimaVista cancels an order after payment has been captured, any amount due to the customer for the cancelled order will be refunded to the original payment method, subject to applicable law and payment-processing times.
6. Payment
Payment methods available to you are displayed during checkout.
Payment processing may be provided by Shopify and other authorized payment providers.
You agree to provide valid payment and billing information and confirm that you are authorized to use the payment method submitted with your order.
Orders may be subject to payment authorization, fraud screening, verification, or other security procedures before fulfillment.
7. Prices
Prices are displayed in the currency shown during checkout.
PrimaVista may change product prices at any time. Price changes apply to future purchases and do not retroactively change the agreed price of a completed order.
Taxes or other applicable charges, if any, may be calculated or displayed during checkout or handled as required by applicable law.
We make reasonable efforts to ensure pricing accuracy. If a material pricing error is discovered after an order has been submitted, PrimaVista may contact the customer, decline or cancel the affected order where appropriate, and refund any amount due if payment has already been captured.
8. Print-on-demand production
PrimaVista products are made to order. Each item is produced specifically for the customer after an order has been placed, reviewed, and submitted for fulfillment.
If you need to cancel or modify an order, please contact us as soon as possible.
We can only attempt to cancel or modify an order before it enters production.
Once production has begun, the item has been printed, or the order has been shipped, cancellation or modification may no longer be possible.
Submitting a cancellation or modification request does not mean that the request has been accepted. A cancellation or modification is confirmed only when PrimaVista provides confirmation.
Customers are responsible for reviewing and selecting the correct product, variant, size, phone model, design, and other available options before completing an order.
9. Shipping
PrimaVista currently accepts orders for delivery to eligible shipping addresses within the United States.
Delivery dates and delivery timeframes are estimates and are not guaranteed.
Production and delivery may be affected by fulfillment availability, destination, carrier operations, weather, logistical disruptions, address issues, seasonal demand, and other circumstances.
Once tracking confirms that an order has been accepted into the shipping carrier's network, transit and delivery are handled by the carrier.
To the fullest extent permitted by applicable law, carrier-related delays, routing errors, failed delivery attempts, misdeliveries, delivery disruptions, incorrect delivery scans, or other issues attributable to the carrier do not automatically entitle the customer to a refund, replacement, or complimentary reprint.
PrimaVista may review individual shipping-related cases and assist where appropriate, but such review does not constitute a guarantee of compensation.
Please refer to our Shipping Policy for complete shipping terms, including tracking, apparently lost shipments, packages marked as Delivered, incorrect addresses, and returned or unclaimed shipments.
10. Returns and refunds
Returns, refunds, replacements, reprints, exchanges, and cancellations are governed by our Return and Refund Policy.
Because PrimaVista products are made to order, we do not accept returns, refunds, or exchanges for change of mind, incorrect product selection, incorrect size or phone model selection, or other customer preference reasons.
Claims involving products that arrive damaged, defective, or different from what was ordered must be submitted in accordance with the requirements and timeframe stated in our Return and Refund Policy.
Nothing in these Terms or our Return and Refund Policy limits any rights that cannot lawfully be excluded under applicable law.
11. Phone cases and product selection
Customers are responsible for selecting the correct phone model and product variant before placing an order.
Please verify the exact model of your device before completing your purchase.
We do not accept returns, refunds, exchanges, or complimentary replacements when an incorrect phone model or product variant was selected by the customer, except where otherwise required by applicable law.
12. Fine art posters and frames
Unless clearly stated otherwise on the individual product page, PrimaVista fine art posters are sold unframed.
Frames, mats, furniture, props, and other decorative elements shown in product photographs or mockups are for presentation or styling purposes only unless expressly identified as included with the product.
Customers are responsible for reviewing the product description before purchasing.
13. Intellectual property
Unless otherwise stated, the original content and commercial presentation of the PrimaVista website, including branding, logos, original text, product descriptions, graphic elements, layouts, product designs, compositions, and other proprietary materials, are owned by, licensed to, or lawfully used by PrimaVista.
Some products feature or are inspired by artworks that are in the public domain or otherwise lawfully available for use.
PrimaVista does not claim copyright ownership over an underlying public-domain artwork merely because that artwork appears on a PrimaVista product.
However, public-domain status of an underlying artwork does not grant permission to copy PrimaVista's independent branding, original written content, original designs, proprietary compositions, website presentation, or other materials that may themselves be protected.
You may not copy, reproduce, distribute, commercially exploit, or otherwise use protected PrimaVista content without authorization, except where permitted by applicable law.
14. Third-party services
PrimaVista relies on third-party service providers to operate certain aspects of the Services, including ecommerce infrastructure, payment processing, production and fulfillment, shipping, analytics, and other technical or business functions.
These services may occasionally experience interruptions, delays, technical errors, or other events outside PrimaVista's reasonable direct control.
To the fullest extent permitted by applicable law, PrimaVista is not responsible for losses caused solely by third-party events outside our reasonable control where responsibility cannot legally be attributed to PrimaVista.
Nothing in this section excludes any responsibility or consumer right that cannot lawfully be excluded.
Your personal information may also be processed by service providers as described in our Privacy Policy.
15. Limitation of liability
To the fullest extent permitted by applicable law, PrimaVista shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of the website, Services, or products.
This limitation does not apply where liability cannot lawfully be excluded or limited.
Nothing in these Terms is intended to exclude or limit liability for fraud, intentional misconduct, or any other liability that applicable law does not permit us to exclude or limit.
16. Accuracy of website information
We make reasonable efforts to keep the information presented on the website accurate and current.
However, information may occasionally contain errors, omissions, or outdated details concerning matters such as product descriptions, prices, availability, production, shipping, or other store information.
Where an error is identified, PrimaVista may correct the information, contact an affected customer where appropriate, or cancel an affected order where reasonably necessary.
If a paid order is cancelled by PrimaVista because of such an error, any amount due to the customer will be refunded to the original payment method.
17. Applicable law and consumer rights
These Terms and transactions made through the Services are subject to applicable law, including any mandatory consumer-protection rules and applicable rules governing cross-border transactions.
Nothing in these Terms is intended to deprive a consumer of any mandatory rights or protections that apply to them and cannot lawfully be waived or excluded by contract.
18. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law or, where necessary, treated as severed from these Terms.
The validity and enforceability of the remaining provisions will not be affected.
19. Entire agreement
These Terms, together with the policies and conditions expressly incorporated or referenced in them, constitute the terms governing your use of the Services and purchases from PrimaVista.
This includes, where applicable, our:

other terms or notices presented during the purchase process.
20. Changes to these Terms
PrimaVista may update these Terms from time to time to reflect changes to our Services, business practices, legal requirements, or other operational circumstances.
The revised Terms will be posted on this website together with an updated revision date.
Unless otherwise required by applicable law, changes apply prospectively and do not retroactively alter the terms governing an order already placed.
Your continued use of the website after revised Terms become effective constitutes acceptance of the Terms applicable to future use of the Services.
